1. Purpose

These terms and conditions (the "Terms") govern access to and use of the website available at www.onionstudio.be (the "Site"), published by Onion SRL. By browsing the Site, you accept these Terms without reservation. If you do not agree with them, please do not use the Site.

The Site is freely accessible to any user with an internet connection. All costs required to access it (equipment, connection, etc.) are the user's responsibility.

Onion SRL does its best to ensure quality access to the Site but is under no obligation to do so. Onion SRL cannot be held liable for any temporary unavailability of the Site, in particular related to maintenance, updates, or causes beyond its control.

4. Intellectual property

All elements making up the Site (text, images, videos, visual identity, logos, layout, code) are, unless stated otherwise, the exclusive property of Onion SRL and are protected under Belgian and international intellectual property law.

Any reproduction, representation, modification or use, in whole or in part, of these elements without the prior written authorisation of Onion SRL is strictly prohibited and may constitute an infringement.

5. Client projects displayed

The Site showcases work and projects carried out for Onion Studio clients. These projects are published with the agreement of the clients concerned, for the purpose of demonstrating our work (portfolio). Trademarks, logos and visual elements belonging to these clients remain their exclusive property.

If you are a client and would like a project to be removed or amended on the Site, please contact us using the details in section 12.

6. Our services

Onion Studio is a branding and communication agency. The Site is intended to present our activity and our work, and to allow prospective clients to get in touch via the dedicated form. The Site is not an online store: no order or payment can be made through it.

Any service is subject to a separate quote, commercial proposal or contract, negotiated and signed independently with the client, whose specific terms take precedence over these Terms for anything relating to the performance of the service.

8. Liability

Onion SRL makes every effort to provide accurate and up-to-date information on the Site, without however guaranteeing the accuracy, completeness or currency of that information.

Onion SRL cannot be held liable for any direct or indirect damage resulting from the use of the Site, a service interruption, a technical malfunction, or the presence of viruses, except in the event of gross or intentional misconduct on its part.

9. Personal data and cookies

The processing of your personal data in connection with your use of the Site (in particular via the contact form) is described in our Privacy Policy. The use of cookies and similar technologies is detailed in our Cookie Policy.

10. Governing law and disputes

These Terms are governed by Belgian law. In the event of a dispute and failing an amicable resolution, the courts of the judicial district of Brussels shall have exclusive jurisdiction, subject to any mandatory consumer protection rules applicable to users acting outside their professional activity.

If you are a consumer residing in the European Union, you may also use the European Online Dispute Resolution platform, available at ec.europa.eu/consumers/odr, or the Belgian Consumer Mediation Service (mediationconsommateur.be).

11. Changes to these terms

Onion SRL reserves the right to amend these Terms at any time, in particular to comply with any regulatory, technical or case-law developments. The version in force at the time you consult the Site is the applicable one.
